The appeals filed by Chief Edozie Njoku, Jude Okeke, and Hon Wilson Onyekwelu were dismissed with hefty costs by the Court of Appeal, Awka Division, led by Presiding Justices Hon Justice C Nwosu-Iheme. The Court of Appeal highlighted in its judgement on the petitions on Monday, August 2nd, 2021, that the applicants’ applications were severely incompetent and so liable to be dismissed.
As a result, the court dismissed the three cases with substantial costs in favour of the APGA led by Chief Victor Oye.
The Presiding Justice was particularly critical of the way various frivolous suits were filed in connection with the APGA’s primary election for Governor of Anambra State in various states outside of Anambra, despite the Supreme Court’s admonition that State High Courts have territorial jurisdiction. The presiding Justice, enraged, demanded harsh and immediate disciplinary action against the judges and counsel involved in the bogus judgments obtained in Jigawa State, Imo State, and the High Court of the Federal Capital Territory for bringing the judiciary’s image into disrepute and public ridicule.
It will be recalled that Justice C.C. Okaa issued an unequivocal ruling reaffirming Dr. Ike Victor Oye as APGA’s National Chairman and Prof. Charles Chukwuma Soludo, CFR, as the party’s undeniable governorship candidate. The appellants have filed motions to overturn the decision. They were kicked out.
As the sole legally sanctioned and INEC recognised officers of APGA, Chukwuma Umeoji had paid for nomination papers and also attended for screening at the Dr Ike Victor Oye led national executive. When he and four others were disqualified, he named Jude Okeke, who is unknown to the APGA, as his new national chairman.
As a result, they began looking for courts and judges who could issue spurious court orders. They secured such orders from the state high courts of Jigawa, Abuja, and Imo. Such nonsense has been frowned upon by the Awka Court of Appeal.
